Randal Payne has been awarded an AV® Peer Review Rating by Lexis Nexis Martindale-Hubbell (which identifies lawyers with very high to preeminent legal ability); has been Board Certified in Civil Trial Law by the Texas State Board of Legal Specialization since 1996; and practices Business Law, Commercial Litigation, Anti-Trust Litigation, Insurance litigation, health law and serious Personal Injury & Wrongful Death litigation.
Beginning in 1985, Mr. Payne has been involved in advising and representing national and international business clients on a broad range of risk exposure limitations strategies, compliance and revenue recovery matters. Mr. Payne’s Business Litigation and operational experience includes drafting federal and state compliant contracts, transactional forms, policies and procedures; consulting and providing in-service training for executives and management personnel; drafting opinion letters on the applicability of federal and state statutes, regulations and case law to business formation, operations, and activities.
Additionally Mr. Payne has extensive trial experience defending and prosecuting claims on behalf of businesses and individuals in litigation involving breaches of contract breaches of warranty, fraud, breaches of fiduciary duties, conspiracy, negligence, deceptive trade practices, trademark infringement, Sherman Anti-trust Act violations, OSHA violations, copyright infringement, wrongful death, and tortuous interference with business relationships.
On behalf of his hospital clients, Mr. Payne has successfully prosecuted numerous cases against insurance companies, HMOs, PPOs and governmental entities to recover the cost of healthcare on denied claims. He has successfully prosecuted cases of first impression, which created appellate precedents under Texas law. See Harris County v. Hermann Hospital 943 SW2nd 547(Tex. App. - Eastland 1997) (Mr. Payne was successful at having a $745,863.56 judgment for his client affirmed on appeal).
Mr. Payne occasionally testifies during legislative hearings before Committees considering legislation affecting businesses; and on behalf of business interests he has drafted and submitted formal comments to Texas regulatory departments on proposed repeal and adoption of regulations relating to issues affecting businesses. He has attended workshops with Texas regulatory departments and other business interests to develop rules affecting business interests
